Hipstamatic LLC (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use Last Camera (the “App”). By using the App, you consent to the practices described in this Privacy Policy. If you do not agree with this policy, please do not use the App.

1. Information We Collect

We collect the following types of information when you use the App:

1.1 Personal Information

Sign in with Apple: When you register for a profile using Sign in with Apple, we collect your Apple ID-associated information, such as your name and email address (if not hidden via Apple's private email relay). This information is used to create and manage your user account.

User-Entered Data: You may provide additional information, such as your name and Instagram handle, when uploading content. This data is considered personal information if it can be used to identify you.

1.2 Content and Metadata

Images: The App allows you to capture and upload images (“Content”).

Metadata: When you upload Content, we may automatically collect metadata, including but not limited to:

• Location data (if you enable location services)
• Timestamp of the image
• Weather data at the time and location of capture
• User-entered data, such as your name and Instagram handle

You are responsible for the accuracy of any user-entered data and for disabling location services if you do not wish to share location data.

1.3 Usage Data

We may collect information about how you interact with the App, such as your device type, operating system, IP address, and usage patterns, to improve the App’s functionality and user experience.

2. How We Use Your Information

We use the information we collect for the following purposes:

Account Management: To create and manage your user account via Sign in with Apple.

Content Processing: To process and store your Content and metadata on iCloud using Apple CloudKit.

Open-Source Artwork: To use your Content and metadata as open-source artwork under the Creative Commons Attribution 4.0 International License (CC BY 4.0) or a similar open-source license for purposes such as books, exhibitions, and other commercial and non-commercial uses, as outlined in our Terms of Service.

NFT Creation: To create, mint, distribute, and sell Non-Fungible Tokens (NFTs) on blockchain platforms using your Content and metadata, as permitted by our Terms of Service.

Attribution: To provide attribution for your Content (e.g., using your name or Instagram handle) when used in our projects or by third parties under the open-source license.

App Improvement: To analyze usage data to improve the App’s performance, functionality, and user experience.

Communication: To send you updates, notifications, or respond to your inquiries.

3. How We Share Your Information

We may share your information as follows:

Open-Source Sharing: Your Content and metadata (e.g., location, name, Instagram handle, timestamp, weather data) may be shared publicly as open-source artwork under the CC BY 4.0 license (or similar). This allows third parties to use, share, and adapt your Content with appropriate attribution.

NFTs on Blockchain: Your Content and metadata may be tokenized as NFTs on blockchain platforms, making them publicly accessible and potentially tradable. This includes associating your name or Instagram handle with the NFT for attribution purposes.

Service Providers: We may share your information with third-party service providers, such as Apple (for iCloud and CloudKit services), to facilitate the App’s functionality. These providers are bound by their own privacy policies and terms.

Legal Compliance: We may disclose your information if required by law, regulation, or legal process, or to protect our rights, property, or safety, or that of others.

4. Data Storage and Security

iCloud Storage: All Content and metadata are stored securely on iCloud using Apple CloudKit, subject to Apple’s privacy policies and security measures. We are not responsible for Apple’s handling of your data.

Security Measures: We implement reasonable technical and organizational measures to protect your information from unauthorized access, loss, or misuse. However, no system is completely secure, and we cannot guarantee absolute security.

Blockchain Data: If your Content is minted as an NFT, it will be stored on a public blockchain, which is inherently decentralized and publicly accessible. You acknowledge that blockchain data cannot be deleted or modified once minted.

5. Your Choices

Location Data: You can disable location services in your device settings to prevent the collection of location metadata. Note that disabling location services may limit certain App features.

User-Entered Data: You can choose not to provide certain information, such as your name or Instagram handle, but this may affect how your Content is attributed.

Account Deletion: You may request deletion of your Content from our servers by contacting us at support@hipstamatic.com. However, Content already shared under the open-source license or minted as NFTs cannot be retracted due to the public nature of these platforms.

6. Third-Party Services

The App uses Sign in with Apple and iCloud (via Apple CloudKit), which are subject to Apple’s privacy policies. We encourage you to review Apple’s privacy policy at www.apple.com/legal/privacy for details on how your data is handled by Apple.

7. Children’s Privacy

The App is not intended for users under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will take steps to delete it.

8. International Users

The App is available globally. We comply with international data protection laws, including the General Data Protection Regulation (GDPR) for users in the European Union. By using the App, you consent to the processing of your data in accordance with this Privacy Policy, regardless of your location.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App or via email. Your continued use of the App after such changes constitutes your acceptance of the revised Privacy Policy.
